| RTS WASTE MANAGEMENT / WASTEOLOGY /CROSSWAYS RECYCLING TERMS AND CONDITIONS Contract period The contract shall be for a minimum period of 12 months from the first collection date and shall continue thereafter for successive periods of 12 months unless terminated by prior written notice by the customer. Such notice to be given not less than 60 days before the end of any 12 month period and to expire at the end of the minimum period or at the end of any subsequent 12 month period. Nature of waste to be collected The customer undertakes that the waste/s provided to the contractor will not constitute special waste as defined in the Control of Pollution (Special Waste) Regulations 1980 or subsequent legislation and will not contain any dangerous or polluting substances. Containers - Responsibility The customer accepts responsibility for any loss or damage, including fire, to any containers owned/supplied by the contractor while such equipment is in the customers' custody or control pursuant to this contract. The customer shall indemnify and hold harmless the contractor from and against any and all claims for loss or damage to property or injury or death of person or persons, resulting from or arising in any manner out of customers' use, operation or possession of any containers so furnished pursuant to this contract. Cleaning Responsibility for washing down grease/fat and other staining(s) left on the highway, will be the customer. Charges The contractor may adjust the charges from time to time by giving the customer 30 days prior notice in writing. Any increase in charges other than necessary to recover actual increases in fuel and landfill charges shall normally be advised annually. Variations Any variations to the charges, the type, size and amount of containers and the frequency of collection may be agreed in writing by the parties without affecting the other clauses in the contract. Changes in nature of waste Any change in the description of the waste specified in the duty of care statement provided by the customer must be immediately notified to the contractor in writing in advance of any such change to enable an updated duty of care statement to be provided by the customer. Assignment The agreement may be assigned, transferred or otherwise dealt with by the contractor and shall inure to the benefit of the successors and assigns of the contractor.
